Terms governing the use of our VTC transport service

1. Purpose and Scope

These Terms and Conditions of Use (CGU) govern the use of the passenger transport service by private hire vehicle (VTC) provided by TY-ZEF Brest VTC, EURL CELIONALO, registered with the Register of VTC operators under number EVTC 0564604 and with the Trade and Companies Register under SIREN number 103 115 333, whose registered office is located at 20 rue Docteure Mireille BELLET 29200 Brest.

Use of our services (booking by telephone, SMS, email, website or platform) implies full and unreserved acceptance of these Terms and Conditions by the customer or passenger.

2. Definitions

  • VTC : private hire vehicle with driver, in accordance with Articles L. 231 1 et seq. of the Tourism Code.
  • Customer : any natural or legal person placing an order or reservation.
  • Passenger(s) : any person transported as part of the service.
  • Vehicle : private hire vehicle with driver, compliant with legal requirements (age, engine, seats, etc.).

3. Nature of the Service

TY-ZEF Brest VTC provides paid passenger transport services for pre-booked journeys, in accordance with applicable VTC regulations.

Services offered may include in particular:

  • Home / airport / train station / hotel / workplace transfers;
  • On-demand services (round trips, chauffeur availability, concierge, event shuttles).

Any service is deemed accepted upon confirmation of the booking (by telephone, SMS, email, online form, etc.).

4. Booking and Confirmation

VTC rides are strictly pre-booked, with a minimum of 15 minutes between booking and pick-up, unless explicit exemption is granted by TY-ZEF Brest VTC.

The customer provides TY-ZEF Brest VTC with: pick-up and drop-off times, precise addresses, number of passengers and luggage, and any special needs (baby seat, assistance, etc.).

TY-ZEF Brest VTC reserves the right to refuse a booking in the event of vehicle unavailability, technical constraints or failure to comply with safety conditions.

5. Rates and Payment

Prices are indicated in euros, all taxes included (TTC), with no hidden additional fees, unless otherwise stated on the quote or order form.

The fare may include: transport price, booking fees, excess luggage fees, or any other item previously communicated to the customer.

Payment is made:

  • Either by bank card on board or via an online payment system;
  • Or by bank transfer or invoice according to terms agreed for corporate customers.

Refusal to pay at the time of service may result in invoicing of costs incurred and recourse to collection measures.

6. Cancellation, Changes and Delays

Cancellation

  • If cancellation is made more than 24 hours before the ride, no penalty is applied.
  • For cancellation between 24 and 2 hours before the ride, a penalty of 50% of the amount may be invoiced.
  • For cancellation less than 2 hours before the ride or "no show", the full amount of the ride will be invoiced.

Changes

Any change to the route, number of passengers or type of vehicle must be immediately reported to TY-ZEF Brest VTC and may result in a fare revision.

Customer delay

If the customer arrives more than 10 minutes late without notice, TY-ZEF Brest VTC reserves the right to consider the service as not performed and to invoice the costs incurred.

7. Transport Conditions and Conduct

TY-ZEF Brest VTC reserves the right to refuse or interrupt any transport in the event of:

  • Apparent intoxication, aggression, threats or violent behaviour towards the driver or other passengers;
  • Presence of illicit substances, weapons or unauthorised animals (unless prior agreement);
  • Only guide dogs and assistance dogs are permitted on board.
  • Failure to comply with on-board safety rules (seatbelts, baby seats, undeclared additional passengers, etc.).

In the event of refusal of transport for these reasons, the full amount of the ride will be invoiced.

The Customer undertakes to use the vehicle with care and to report any incident immediately. In the event of damage, including vomiting, bodily soiling or any soiling requiring specialist cleaning, a flat fee of €150 incl. tax will be applied to cover professional cleaning costs and any loss of business.

For any material damage (scratches, impacts, tears, etc.): a quote will be obtained from an approved professional. The cost of the quote (approximately €100-150) and repairs will be invoiced in full to the Customer (in accordance with Article 1240 of the Civil Code), plus loss of business during downtime at the rate of €300 incl. tax per day.

8. Luggage, Personal Belongings and Liability

The number and volume of luggage must be declared at the time of booking. An additional charge may apply for exceptional luggage or bulky equipment.

TY-ZEF Brest VTC declines all liability for the loss, theft or deterioration of personal belongings left on board or in the vehicle, unless proof of serious negligence on its part.

Pets are only accepted subject to prior approval and may give rise to an additional cleaning fee.

9. Personal Data and Privacy

Booking data (name, telephone, address, possibly email address) is collected and processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

This data is used only for:

  • Order and transport management;
  • Issuing invoices;
  • Sending essential information (delays, vehicle changes, etc.).

Under no circumstances does TY-ZEF Brest VTC transfer this data to third parties for commercial purposes.

10. Insurance and Liability

TY-ZEF Brest VTC holds extended professional civil liability insurance covering passengers and third parties, in accordance with legal VTC requirements.

The liability of TY-ZEF Brest VTC is limited to the direct and foreseeable consequences of its activity, within the strict framework of the transport contract. It shall not cover indirect damages (loss of opportunities, professional delays, etc.) except in cases of gross negligence or serious fault.

11. Intellectual Property

The website, any application, logos, booking forms and associated content are the exclusive property of TY-ZEF Brest VTC. Any reproduction, representation or use without written authorisation is strictly prohibited.

12. Force Majeure

TY-ZEF Brest VTC shall not be held liable in the event of non-performance or delay attributable to a case of force majeure (storm, unforeseeable major traffic jam, exceptional breakdown, strike, accident, security event, etc.).

In such case, TY-ZEF Brest VTC undertakes to inform the customer as soon as possible and to propose an alternative solution or a postponement/re-adjustment of the service where possible.

13. Applicable Law and Disputes

  • These Terms and Conditions are governed by French law.
  • Any claim or dispute relating to the interpretation, performance or termination of these Terms and Conditions shall be submitted first to an amicable conciliation attempt.
  • Failing amicable settlement, the dispute shall be brought before the competent courts within the jurisdiction of the city of Brest, or before the competent court according to the customer's status.

14. Effective Date and Amendments

These Terms and Conditions take effect on the date of their publication on the site or on the date of the customer's first booking. TY-ZEF Brest VTC reserves the right to modify them at any time. Modifications will be notified to the customer by email or via the site, and will apply to new bookings as of their publication.
